استباحة دماء الأبرياء، الخطورة – الأسباب – العلاج، دراسة موضوعية في ضوء السُّنة النبوية

أظهرتِ السُّنَّة النبوية عناية فائقة بالنفس البشرية وَعَدَّتِ الحفاظ عليها حقًّا أساسيًا لکل فرد في المجتمع. وقد ماجت الأرض هذه الأيام بفتن أظهرت ممارسات مستبشعة في إهدار ما للنفس من کرامة ودم وحرمات. سلط هذا البحث الضوء على مفهوم النفوس المحرمة، وأنواع الجنايات عليها، وما يترتب على ذلک من العقوبات الدنيوية والأخروية، مع استعراض الأسباب التي تؤدي إلى هذه الجنايات وسبل مواجهتها وعلاج آثارها. أکدت نتائج الدراسة إثبات الحرمة لنفس کل أفراد المجتمع مسلمين وغير مسلمين، وأنه يجب على المسلم کف يده ولسانه في مواضع الفتن. کما بينت دوافع استباحة النفوس المحرمة، وأنها تتلخص في ثلاثة أقسام: ذاتية (مثل الغضب والشح والإدمان)، أو مجتمعية (مثل التعصب والمناخ التحريضي ضد المخالف)، أو فکرية (مثل الجهل وغياب المنهج الصحيح). ومن أهم ما يجب فعله لمواجهة هذه الأخطار العمل على تنمية الوازع الديني والتبصير بهذه الحرمات وإشاعة روح الإخاء والتسامح، بالإضافة لتطبيق الحدود الشرعية وتغليظ العقوبات التعزيرية على کل من يستهين بحرمة النفس البشرية.

Abstract:
The sunnah of prophet Mohammad peace be upon him has shown great care of the human soul, thus it considered the sanctity of the human soul as a fundamental right for each individual of the society. Nowadays, sedition and corruption filled the globe showing terrible practices against human dignity and the sanctity of blood. This research shed light on the concept of the sanctity of the human soul, and the types of crimes commited against it, and it shed light also on the punitive sanctions that the islamic law has decided for these terrible crimes in this lifetime or in the hereafter, including a review of the causes that led to these crimes, exposing ways to cure them and cure their effects.
The results of this study has proved a same inviolability for all members of society, Muslims and non-Muslims, and it also proved that the Muslim must keep-off his hand and his tongue in the case of sedition. It also showed the motivations that led to the violation of the infallible souls, which have been divided through this research into three reasons: personal motives (such as anger and stinginess and addiction), Societal motives (such as the climate of intolerance and incitement against others), or intellectual motives (such as ignorance and the absence of the proper religious curriculum).
The most important thing we should do to cope with these dangers is to develop the concept of the religious faith, and to clarify the sanctity of the human soul and foster a spirit of brotherhood and tolerance, as well as to apply the legitimate borders and harsher the punitive sanctions on any person who trivializes the sanctity of the human soul.
