لقد هيأ الله تعالى لهذه الأمة من يحمل لواء الفقه في الدين، من لدن صحابة النبي صلى الله عليه وسلم صلى الله عليه وسلم  وعلى مر الأيام والسنين، فحفظ الله بهم الملة، وأحيا بهم الأمة، وأقام بهم الحجة، حتى بلغنا دين نبينا صلى الله عليه وسلم  غضاً طريًا کما أنزل.
وقد بذل أولئک الفقهاء رحمهم الله جهودًا عظيمة في استنباط أحکام الشريعة وتقريبها للمتفقهين، فدونوا المدونات على تنوع طرائقها ومناهجها ومقاصدها، مما أُثريت به الساحة العلمية الفقهية في سائر مذاهبها.
وإن من مشهور المذاهب الفقهية المتبوعة مذهب إمام دار الهجرة مالک بن أنس رحمه الله (179هـ) الذي أخذ عنه کثير من علماء الإسلام، ودونوا فقهه، وحملوه إلى أقطار المعمورة، وقعَّدوا لمذهبه القواعد والأصول، حتى صار العمل به ظاهرًا في کثير من بلدان المسلمين.
وقد توصلت من خلال هذه الدراسة إلى بعض النتائج أهمها:ما جرى بيانه يتضح أن المعنى الأقرب للمراد بما جرى به العمل هو: العدول عن القول الراجح أو المشهور في بعض المسائل إلى القول الضعيف فيها؛ رعيا لمصلحة الأمة، وما تقتضيه حالتها الاجتماعية.
والحکم بما جرى به العمل نوع من الاجتهاد لا يقوم عليه إلا من أوتي حظا من البصيـرة بمقاصد الشرع، والنظر في مصالح الخلق.
 Abstract:
God has prepared for this nation those who carry the banner of jurisprudence in religion, from the prophet's companions, and over the days and years, god bless them, and the nation revived them, and made them the argument, until we reached the religion of our Prophet( peace be upon him) softly as he revealed.
These jurists, may God rest their soul, have made great efforts in devising the provisions of sharia and bringing it closer to the agreed ones, and they have written blogs on the diversity of their methods, methods and purposes, which have enriched the scientific field of jurisprudence in all its doctrines..
One of the famous doctrines followed by the doctrine of Imam of Dar al-Hijra Malik bin Anas (179 Ah), from which many Scholars of Islam took, wrote his jurisprudence, carried him to the countries of the globe, and signed his doctrine of rules and origins, until the work of it became apparent in many Muslim countries..
Through this study, I have reached some conclusions, the most important of which is: what has been explained shows that the meaning closest to what has been done is: to refrain from the most correct or well-known statement in some matters to the weak saying in them;.
Judging by what has been done is a kind of diligence based only on the best of insight into the purposes of Islam, and considering the interests of creation..
