المستخلص

في الشريعة الغراء أحكام تعم جميع المكلَّفين بلا استثناء،وأحكام تخص فريقًا دون فريق ،وأحيانًا يقع التشابه بين ما هو عام، وما هو خاص،فينشأ عن ذلك الخلاف بين الفقهاء،ولكن غالبًا ما يكون هذا الخلاف هينًا،أو لفظيًّا إذ كثيرًا ما تكون القرائن على التخصيص والتعميم ظاهرة جلية لا يتأتَّى معها خلاف ، فتخصيص العام -مهما اختلفت أسمائه مهم جدًّا وضروري في فهم المراد من النصوص الشرعية والقانونية وفي كلام الناس، لما يترتب على التعميم من أخطاء فاحشه، ونتائج غريبة، ومن هنا كانت معرفة الخاص والعام ضرورية لأهل الاجتهاد والفتوى؛لأن القطع بصحة الأحكام متوقِّفٌ عليها.وقد قمت بعزو الآيات القرآنية،وتخريج الأحاديث النبوية من مصادرها الصحيحة، ونسبة الأقوال لقائليها، واعتمدت على المصادر الأصيلة في كل فن،والترجيح بين الأقوال ما أمكن،وقد توصلت إلى أن العام يشمل كل الأفراد أما الخاص فيشمل بعض الأفراد دون البعض،أغلب العام يدخله التخصيص،لمعرفة العام والخاص أهمية كبيرة في حياتنا حيث أنه يعيننا على فهم القرآن الكريم الذي هو دستور حياتنا، إرتباط العام والخاص بفهم الأحكام الشرعية ارتباطا وثيقاً.
وأخيراً فإني أوصي نفسي وإخواني من طلبة العلم بالعكوف على دراسة القرآن الكريم،والإخلاص في دراسته يفتح للباحث مسائل هامة ،ويفيض الله عليه من العلم مالا يستطيع الوصول إليه إلا به، ضرورة البحث في المباحث الأصولية، والعكوف على دراستها؛حيث أن فهم القرآن فهماً صحيحاً يتوقف على معرفتها.
 
Abstract:
In the noble Sharia, there are provisions that apply to all those who are charged without exception, and provisions that are specific to a group without a group, and sometimes the similarity occurs between what is general and what is specific, and a dispute arises among the jurists, but often this disagreement is slight, or verbal as often the clues are Specialization and generalization is a clear phenomenon with which no disagreement arises, so the specialization of the general - no matter how different its names are is very important and necessary in understanding what is meant by the legal and legal texts and in people's words, because of the obscene errors and strange results, and hence knowledge of the private and the general is necessary for the people of diligence And the fatwa; because defining the validity of the rulings depends on it. It includes some individuals without others, most of the year is involved in privatization, knowledge of the general and the specific is of great importance in our lives as it helps us to understand the Noble Qur’an, which is the constitution of our life, and the general and special connection with understanding the legal rulings is closely linked.
Finally, I advise myself and my brothers among the students of knowledge to devote themselves to studying the Noble Qur’an, and being sincere in its study opens up important issues for the researcher, and God will pour on him knowledge that he cannot reach without him, the necessity of researching the fundamentalist investigations, and focusing on studying them, as understanding the Qur’an is a correct understanding. Depends on her knowledge.
