التحكيم الزوجي في القرآن الكريم دراسة تفسيرية وصفية مقارنة بنظام التحكيم السعودي

يُعنى البحث بدراسة آية التحكيم الواردة في سورة النساء وهي قوله تعالى: ﭽوَإِنْ خِفْتُمْ شِقَاقَ بَيْنِهِمَا فَابْعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا إِنْ يُرِيدَا إِصْلَاحًا يُوَفِّقِ اللَّهُ بَيْنَهُمَا إِنَّ اللَّهَ كَانَ عَلِيمًا خَبِيرًا ﮕﭼ، دراسةً وصفيةً من خلال أقوال المفسرين والفقهاء، وبيان أبرز ما يتعلق بها من مسائل وهي: من الآمر بالتحكيم: هل هو السلطان أو الزوجان؟ وتكييف التحكيم: هل حكم أو وكالة؟ ومقدار نظر الحَكَمَين: هل يقتصر فيما وكلهما به الزوجان وصرحا بتقديمهما عليه، أو ينظران في الإصلاح، وفي الأخذ والإعطاء، إلا في الفرقة، أو ينظران في كل شيء، ويحملان على الظالم، ويمضيان ما رأياه من بقاء أو فراق؟.
كما يُعنى البحث بمقارنة ذلك بنظام التحكيم السعودي المعاصر، وبيان العلاقة بين أقوال العلماء في تحليل الآية، والوارد في نظام التحكيم السعودي.
وقد قدمت قبل تحليل الآية بتعريف التحكيم في اللغة واصطلاح المعاصرين، كما خُتمت الدراسة بذكر أبرز النتائج العلمية منها.

Abstract:
The research is concerned with studying the arbitration verse contained in Surat An-Nisa, which is the Almighty’s saying: (35) And if you fear dissension between the two, send an arbitrator from his people and an arbitrator from her people. If they both desire reconciliation, Allāh will cause it between them. Indeed, Allāh is ever Knowing and Aware. The most prominent issues related to it are: Who ordered the arbitration: is it the Sultan or the couple? Arbitration conditioning: Is it an arbitrator or agency? And the extent of the two arbiters’ consideration: is it limited to what the spouses have entrusted to them and declared their submission to him, or they look at reform, and in giving and taking, except in separation, or they look at everything, and blame the oppressor, and they go about what they saw of survival or separation?.
 The research is also concerned with comparing this to the contemporary Saudi arbitration system, and clarifying the relationship between the sayings of scholars in analyzing the verse, which is contained in the Saudi arbitration system.
It was presented before analyzing the verse by defining arbitration in the language and terminology of the contemporaries, and the study was concluded by mentioning the most prominent scientific results from them.
