التطور الدلالي للمصطلح الفقهي (الفقه المالكي نموذجا)

من الطرق الموصلة لفهم علمٍ ما هو بأخذ هذا العلم من أهله، أو بالبحث عمًا كتبوه في الكتب، وحتى نفهم ما كتبوه لابد من معرفة اصطلاحات أهل هذا العلم، وتطور هذه المصطلحات منذ بدء نشأتها وحتى عصرنا الحاضر حتى نقف على التطورات التي طرأت عليه وبالأخص (المصطلح الفقهي) كون علم الفقه على غرار المصطلحات الأخرى فيض من الاصطلاحات التي يستخدمها الفقهاء ، فتوضح الباحثة في البحث قابلية المصطلح الفقهي للتطور بحيث يعكس مدى مرونة الفقه ومواكبته للحاجات المتغيرة بتغير الزمان والمكان، فلا يكون المصطلح عقبة أمام تطور الفقه.
وقسمت البحث إلى مقدمة، وأربعة مباحث رئيسية، وخاتمة، تناول المبحث الأول: التطور الدلالي: مفهومه، ومظاهره، وأنواعه، وأسبابه. وفيه مطالب، وتناول المبحث الثاني: المصطلح الفقهي: تعريفه، ونشأته، والمصطلح في العصر الحديث، وأهمية المصطلح، وموقف الفقهاء والأصوليين من التطور الدلالي للمصطلح الفقهي، وضوابط المصطلح، وتوحيده. وفيه مطالب، وتناول لمبحث الثالث: تطور المصطلح الفقهي في المذهب المالكي. وفيه مطالب، وتناول المبحث الرابع: تعدد مظاهر المصطلح الفقهي في المذهب المالكي. وفيه مطالب، ثم ختمت البحث بخاتمة وفهرس للمصادر والمراجع.
 Abstract:
One of the ways to understand a science is by learning this science from its people, or by searching for what they wrote in books. In order to understand what they wrote; it is necessary to know the terminology of the people of this science. The development of these terms since their inception until our present time so that we can stand on the developments that have taken place in it, especially (the term fiqh) because the science of jurisprudence, like other terms, is an abundance of conventions used by jurists.
In the research, the researcher clarifies the ability of the jurisprudential term to develop so that it reflects the extent to which jurisprudence is flexible and keeps pace with changing needs with the change of time and place, so that the term is not an obstacle to the development of jurisprudence.
The researcher divided this research into an introduction, four main topics, and a conclusion. First topic dealt with semantic development: its concept, manifestations, types, and causes. It contains demands. Second topic dealt with jurisprudence term: its definition, its origin, the term in modern era, the importance of the term, the position of jurists and fundamentalists on the semantic development of jurisprudence term, term rules, and its unification, it contains demands. Third topic dealt with the development of jurisprudence term in Maliki school of thought, it contains demands. Fourth topic dealt with the multiplicity of manifestations of jurisprudential term in Maliki school of thought, it contains demands. Then the researcher concluded the research with a conclusion and an index of sources and references.
