حدود طاعة المرأة لزوجها في الفقه الإسلامي " خدمة الزوج نموذجًا "

يتلخص موضوع البحث في التعريف بمعنى الخدمة، والطاعة ، وحكمها ، وأدلة طاعة المرأة لزوجها وإيراد أقوال العلماء وخلافهم في حكم خدمة الزوجة لزوجها ، وهل الغرض من الزواج فقط هو منفعة الاستمتاع ، مع ذكر أدلة كل فريق ومناقشتها والترجيح بينها ، وتقع مشكلة البحث وهو السؤال الرئيسي : هل المعقود عليه في عقد النكاح هو منفعة الاستمتاع فقط؟ويتفرع عن السؤال الرئيسي الأسئلة الفرعية التالية : ما الطاعة التي قررتها الشريعة الإسلامية على المرأة ؟وهل الخدمة تدخل في حدود هذه الطاعة؟ ومن أين جاء المفهوم السائد الآن بأن المرأة ليس عليها خدمة زوجها؟
ويهدف البحث إلى تحقيق ما يلي:توضيح مفهومي (الطاعة) و(الخدمة)،والبحث في أدلة الشريعة الإسلامية في رعاية المرأة لبيتها، وعرض الآراء الفقهية في حكم خدمة المرأة .
وتقع أهمية هذه الدراسة في أنها من أهم القضايا المتعلقة بالأسرة التي أصبحت الآن حديث الساعة: خدمة الزوجة في بيت زوجها، وقيامها بشؤون بيتها؛ من طبخ وغسل وتنظيف ونحو ذلك، وهل هذه الخدمة واجبة على الزوجة أم لا؟ وبيان مدى شمولية الشريعة الإسلامية واستيعاب أحكامها لشتى مستجدات الحياة البشرية؛ ومن ذلك: ما يتعلق بالمسائل العرفية المتباينة ذات العلاقة بحقوق الزوج.و الحاجة الملحة إلى بيان الأحكام والضوابط الشرعية المتعلقة بالأعراف المختلفة بوضع ميزان للعرف المعتبر المؤثر في الحكم.وتوضيح مدى اعتبار الشريعة لأعراف الناس وعاداتهم لرفع الحرج عنهم.
وختمت البحث بخاتمة ذكرت فيها أهم النتائج والتوصيات التي توصلت إليها خلال البحث .
 Abstract :
The topic of the research is summarized in the definition of the meaning of service, obedience, and its ruling, and the evidence of a woman’s obedience to her husband, and the statements of scholars and their differences regarding the ruling on a wife’s service to her husband, and is the purpose of marriage only for the benefit of enjoyment, with mentioning the evidence of each team, discussing and weighing them,
The problem of the research lies, and it is the main question: Is what is agreed upon in the marriage contract only for the benefit of enjoyment?
The following sub-questions are branched from the main question: What is the obedience that Islamic Sharia decreed for women?
Does the service fall within the limits of this obedience? Where did the prevailing notion come from now that a woman does not have to serve her husband?
The research aims to achieve the following: clarification of the concepts of (obedience) and (service), research in the evidence of Islamic law in the care of women for their home, and presentation of jurisprudential opinions in the rule of serving women.
The importance of this study lies in the fact that it is one of the most important issues related to the family, which has now become the talk of the hour: the wife’s service in her husband’s house, and her handling of the affairs of her home; From cooking, washing, cleaning and so on, is this service obligatory for the wife or not? Explaining the comprehensiveness of the Islamic Sharia and its understanding of the various developments in human life; Including: what is related to the various customary issues related to the rights of the husband. And the urgent need to clarify the legal rulings and controls related to the different customs by setting a balance for the custom that is considered effective in the ruling. And to clarify the extent to which the Shari’a considers people’s customs and habits to remove embarrassment from them.
and concluded the research with a conclusion in which the most important The results and recommendations reached during the research.
