المستخلص
إن المتتبع للشريعة الإسلامية يجدها تتصف بالثبات في الأصول والأحكام ؛ والمرونة في التطبيق ، وتتجلى هذه المرونة في أكثر من مجال ؛ منها وجود البدائل ؛ بحث يجد المكلف سعة في التنفيذ مع تنوع في الأمور التي تحصل بها براءة الذمة وأداء المطلوب .
وتعرض البحث في المبحث الأول لبيان بعض البدائل في الإسلام مؤيدة بالشواهد القرآنية والأمثلة التطبيقية في الشعائر التعبدية ، والجهاد ، و الكفارات ، والشهادات ، والجزاءات، والعقوبات .
وعرج في المبحث الثاني على مسألتين أصوليتين متعلقتين بالواجب المخير والواجب الموسع ، ووضح فيه أيضا المفوض بالاختيار – أو من له حق الاختيار –بين البدائل .
أما المبحث الثالث فكان لاستنباط الدروس والفوائد الدعوية من موضوع البحث وجزئياته،
وكانت نتائج البحث كما يأتي :- أولا : كثرة ورود البدائل في القرآن الكريم بحيث تشكل ظاهرة قرآنية لا تقتصر على ما تم إيراده بل تتسع لتشمل جميع المجالات.ثانيا : الحكمة من كثرة وجود البدائل في القرآن التسهيل والتيسير على المكلفين في أداء العبادات ونيل الدرجات والعفو عن الزلات ،ثالثا : لولي الأمر أو القاضي الحق في الاختيار بين البدائل المتعلقة بالحق العام أو العقوبات التعزيرية التي له سلطة وصلاحية في إيقاعها،رابعا : إزالة التوهم بأن العقوبات البديلة تغيير للأحكام الشرعية واستبدالها بالأدنى مما عند غير المسلمين ،خامسا : الدروس والفوائد الدعوية التي يمكن استنباطها من موضوع العقوبات البديلة في القرآن الكريم كثيرة تشمل ما يتعلق بالداعية والمدعو وموضوعات الدعوة ووسائلها وأساليبها.
ومن أهم التوصيات: تشجيع الباحثين على إثراء المكتبة العربية بالإنتاج الفكري حول موضوع العقوبات البديلة .وتعزيز الانتماء للهوية الإسلامية ومصادرها الأصلية ( القرآن الكريم والسنة النبوية الشريفة ) فما يستجد عند غيرنا من المنافع ؛ نجد أصوله مع سلامة عواقبه في كتاب ربنا وسنة نبينا عليه الصلاة والسلام . و حث الباحثين على دراسة الظواهر القرآنية المتعلقة بالعلوم المختلفة للاستفادة منها تطبيقا ونشرا لعلوم القرآن وإحياء للإيمان بالله تعالى وبكتابه خاصة في نفوس الشباب.و على الدعاة استنباط الدروس والفوائد الدعوية من النصوص والعلوم الشرعية.
Abstract:
The follower of Islamic law finds it characterized by constancy in principles and rulings. and flexibility in application, and this flexibility is manifested in more than one field; including the existence of alternatives; A research that the taxpayer finds capacity in implementation with a variety of matters that obtain clearance and perform what is required.
In the first topic, the research presented some alternatives in Islam supported by Quranic evidence and applied examples in devotional rituals, jihad, penances, testimonies, penalties, and punishments.In the second topic, he touched on two fundamental issues related to the chosen duty and the expanded duty, and he also clarified in it the one authorized to choose - or who has the right to choose - between the alternatives.
As for the third topic, it was to derive lessons and advocacy benefits from the subject and its parts.The results of the research were as follows: - First: the abundance of alternatives in the Holy Qur’an, so that they constitute a Qur’anic phenomenon that is not limited to what has been mentioned, but rather expands to include all fields.
Second: The wisdom behind the abundance of alternatives in the Qur’an is to make it easier for those who are obligated to perform acts of worship, attain degrees, and pardon mistakes.Third: The guardian or the judge has the right to choose between alternatives related to the general right or disciplinary punishments that he has authority and power to impose.Fourth: Removing the illusion that alternative punishments change the Shari’a rulings and replace them with lesser ones than what non-Muslims have.Fifth: The lessons and advocacy benefits that can be deduced from the topic of alternative punishments in the Holy Qur’an are many, including those related to the preacher, the supplicant, the issues of advocacy, and its means and methods.
Recommendations: Encouraging researchers to enrich the Arab library with intellectual production on the subject of alternative punishments. Promoting belonging to the Islamic identity and its original sources (the Holy Qur’an and the honorable Sunnah of the Prophet), as well as other benefits that are new to us; We find its origins with the safety of its consequences in the Book of our Lord and the Sunnah of our Prophet, peace and blessings be upon him. Urging researchers to study the Quranic phenomena related to the various sciences in order to benefit from them in the application and dissemination of the Quranic sciences and to revive faith in God Almighty and His Book, especially in the hearts of young people.Preachers should derive lessons and propaganda benefits from legal texts and sciences.
