المستخلص
يهدف البحث إلى إبراز حالة من أهم حالات أوجه الخلاف على المدار في الحديث المعل, ألا وهي حالة: الجمع بين أوجه الخلاف على المدار؛ لما في تلك الحالة خاصة من الجمع بين النصوص, وعدم إهمال بعضها -كما في الترجيح-, لا سيما إن كان الأمر يتعلق بحكم فقهي, يترتب عليه العمل, وقد انتهى بي البحث إلى أن أحوال أوجه الخلاف على المدار ثلاث حالات, ألا وهي: الترجيح بين أوجه الخلاف على المدار, والجمع بين أوجه الخلاف, وتضعيف أوجه الخلاف. ذاكرا كل حالة بما لها من قرائن, تميزها عن غيرها من الحالات, معتمدا في ذلك على تقعيد أئمة هذا الشأن, وتطبيقاتهم.
وأوصي الأخوة من طلبة العلم الاهتمام بتلك الحالة الثانية من أحوال الخلاف على المدار, ألا وهي: الجمع بين الأوجه؛ لما في تلك الحالة من الفائدة, ألا وهي: العمل بجميع النصوص, وعدم إهمال بعضها -كما في الترجيح-, لا سيما لو اشتملت على مزيد حكم فقهي, أو نحوه, فياحبذا لو جمعت تلك الأحاديث التي حكم أئمة العلل على الجمع فيها بين الأوجه, ودرسها طلبة العلم, لكان فيها فائدة عظمى
Abstract:
The research aims to highlight one of the most important cases of disagreement over the point of convergence in the hadith that has an error, which is the case: combining aspects of disagreement over the point of convergence; Because in that case there is a special combination of texts, and not neglecting some of them - as in weighting -, especially if the matter is related to a jurisprudential ruling, which entails action
The research concluded that the conditions for the aspects of disagreement on the point of convergence are three cases, namely: weighting between the aspects of disagreement on the point of convergence, combining the aspects of disagreement, and weakening the aspects of disagreement. Mentioning each case with its evidence, distinguishing it from other cases, relying on the imams in this regard and their applications.
I recommend to the students of knowledge to pay attention to this second case of disagreement on the orbit, namely: the combination of aspects; Because in that case there is a benefit, namely: working with all the texts, and not neglecting some of them - as in the weighting -, especially if they include more jurisprudential rulings, or the like, so it is preferable to collect those hadiths that the imams of ills ruled to combine in them between aspects, And studied by the students of knowledge, it would have been of great benefit.
